More than three years after his conviction, Tory Lanez, born Daystar Peterson, is serving a 10-year prison sentence for the 2020 shooting of Megan Thee Stallion following a party at Kylie Jenner’s Hollywood Hills home.
Megan, whose legal name is Megan Pete, testified during the 2022 trial that Lanez shot her in the foot, requiring surgery to remove bullet fragments.
A surgeon also testified, though the fragments themselves were never presented as evidence in court.
Lanez has maintained his innocence since the case first became public and now claims that new information has surfaced that was not disclosed during his trial.
“I believe not only that I was wrongfully convicted, but the amount of new evidence that has emerged since that trial has been overwhelming,” Lanez said during the NBC News interview, conducted from the California Men’s Colony in San Luis Obispo.
The Alleged Missing Evidence
According to Lanez’s attorney, Crystal Morgan, the potential issue centers on medical records that came to light during Megan Thee Stallion’s recent civil defamation lawsuit against blogger Milagro Cooper, which Megan won earlier this month.
During that civil case, Cooper’s attorney, Ronda Dixon, reviewed Megan’s medical records and says she discovered a document that was not included in the records provided to Lanez’s defense during his criminal trial.
The document, which NBC News reviewed, appears to be a pathology report from Cedars-Sinai dated July 14, 2020.
It notes that a hospital security employee collected an evidence bag containing a “foreign body.”
While the document does not list Megan’s name, it does include her date of birth.
Morgan says the document raises serious questions about whether bullet fragments were collected, where they went, and why they were never turned over to the defense.
“It’s missing from our date-stamped official copy of evidence from the criminal trial,” Morgan said. “That’s significant.”
Lanez’s legal team argues this could amount to a Brady violation, referring to the legal rule that requires prosecutors to disclose potentially favorable evidence to the defense.

A Steep Legal Climb Ahead
Last month, California’s Second District Court of Appeal denied Lanez’s appeal, stating there was no ineffective assistance of counsel or trial court error.
His attorneys now plan to petition the California Supreme Court, while also seeking either a pardon or clemency from Governor Gavin Newsom.
Legal experts caution that proving a Brady violation is notoriously difficult. NBC News legal analyst Misty Marris explained that Lanez’s team must show the evidence was withheld, favorable to the defense, and significant enough that it could have changed the jury’s verdict.
“It’s an uphill battle,” Marris said, noting that such appeals are often unsuccessful.
The Los Angeles County District Attorney’s Office did not respond to requests for comment on the allegations.
Tory Lanez Addresses Megan And His Mental Health
Tory emphasized that his fight is with the legal system, not Megan Thee Stallion.
“When I talk about my case, I don’t want it to be taken as me coming at her,” he said. “I’m just asking for somebody in the system to look at my case and ask if this was fair.”
Megan has previously spoken about the toll the shooting and trial took on her mental health, as well as the harassment and threats she faced afterward.
She has obtained a restraining order against Tory, alleging he used surrogates to harass her from prison.
Her attorney did not respond to a request for comment on the interview or the new appeal claims.
Tory Lanez also spoke candidly about his own mental health struggles behind bars, revealing that he was stabbed more than a dozen times earlier this year and nearly lost his life.
“Mentally, I’ve gone through trauma that I sometimes even struggle with,” he said. “I’ve never imagined myself dealing with things like this.”

As Tory Lanez’s legal team prepares its next appeal, the case remains deeply polarizing and emotionally charged. For now, the conviction stands, and any path toward reversal or clemency faces long odds.
Whether the newly discovered document ultimately reshapes the legal outcome or not, the interview adds another chapter to a case that continues to spark intense debate around justice, accountability, and how the system handles high-profile trials.
