A Georgia appellate court delivered the ruling on Thursday, citing an appearance of impropriety linked to Willis’ relationship with former special prosecutor Nathan Wade.

The appellate court’s ruling overturns an earlier decision by Fulton County Superior Court Judge Scott McAffee, who allowed Willis to remain on the case despite acknowledging potential ethical concerns.
Judge McAffee found that Willis’ romantic ties to Wade—who resigned shortly after the concerns were raised—did not necessitate her removal.
The appellate court disagreed, stating:
“While we recognize that an appearance of impropriety generally is not enough to support disqualification, this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings.”
The court emphasized that Willis’ involvement in pretrial decisions had already created public doubt about the case’s integrity, making disqualification the only viable solution.
