Tory Lanez has filed a motion seeking a new trial in the Megan Thee Stallion shooting.
The rapper’s attorney Jose Baez claims the judge “erroneously allowed” jurors to view an Instagram post from The Shade Room that included a comment from Tory claiming Megan’s former best friend, Kelsey Harris, was the shooter.
Tory has filed a declaration claiming his content creator, Joshua Farias, was managing his Instagram account and he’s the one who commented, “that’s not true” on the post and added, “People saying Kelsey shot her.”
Attorney Baez also claims the prosecution ambushed them with the Instagram post mid-trial without allowing them sufficient time to identify who posted it.
Therefore the judge should not have allowed the post to be admitted.
On December 24, 2022, a jury of seven women and five men convicted the 30-year-old Canadian rapper, whose legal name is Daystar Peterson, of assault with a semiautomatic firearm, having a loaded, unregistered firearm in a vehicle, and discharging a firearm with gross negligence.
Tory Lanez faces up to 22 years in prison and deportation when he is sentenced.
In January, Tory’s new attorney David Kenner was successful in getting the judge to delay his sentencing until April.
Unfortunately, due to scheduling conflicts, David Kenner is no longer a part of Tory Lanez’s defense team.
Tory told Rolling Stone, “Due to a scheduling conflict, David Kenner will no longer be a part of my defense team. I would like to thank Mr. Kenner for his hard work and wise counsel. Jose Baez will continue to represent me as first chair and Matthew Barhoma as second chair.”
