A Los Angeles County Superior Court judge is expected to dismiss the charges against the social workers who have the blood of 8-year-old Gabriel Fernandez on their hands. 

Gabriel endured months of beatings and torture before his mother and her boyfriend ultimately murdered him in May 2013. 

Social workers Stefanie Rodriguez, 35 and Patricia Clement, 69, and supervisors Kevin Bom, 41, and Gregory Merritt, 64, failed to take the appropriate measures to protect Gabriel and they falsified documents related to his case. 

They were charged with one felony count of child abuse and one felony count of falsifying public records. 

In January, an appellate panel ruled the social workers should not face charges for failing to protect Gabriel. 

A judge is expected to dismiss the charges on Thursday (July 16).

Pearl Sinthia Fernandez, the mother of Gabriel Fernandez, was sentenced to life in prison without parole after pleading to first-degree murder and admitting the torture allegation.

The boyfriend, Isauro Aguirre, was sentenced to death for first-degree murder and a special circumstance allegation of murder involving torture.
