Pantaleo filed a lawsuit against the New York Police Department on Wednesday claiming the decision to terminate him was “arbitrary and capricious.”
NYPD Commissioner James O’Neill chose to fire Pantaleo following a recommendation from NYPD’s Deputy Commissioner of Trials.
O’Neill said Daniel Pantaleo made a proper arrest up until the point where he placed Eric Garner in a chokehold, a move prohibited by the NYPD.
The commissioner also blamed Eric Garner for resisting arrest.
Under New York civil code, Article 78, Pantaleo has the right to appeal his termination.
Kill a man, get fired for a lil bit, appeal the termination, get your job back, and move on with business as usual. Sounds about right. SMH
